This is Tiberghien Economics' privacy policy. It concerns the processing of personal data of individuals outside our organization (e.g., clients, prospects, business contacts, suppliers, visitors to our premises or website, participants in activities, and job applicants).

2.2. How do we collect your personal data?

Usually you provide your personal data to us yourself. Sometimes we receive your contact details and data about your work history and experience through the organization where you work (your employer, your client, a recruitment agency, etc.) or through a public body (a court, an administration, etc.).

In some cases, we may also find, update, supplement and improve this data through public sources (including the Internet) and social networks.

2.3. Do we transfer your personal data outside the European Union?

Our servers are located in the EU and we will not transfer your personal data to countries outside the European Economic Area unless:

  • at your request; or
  • to the extent necessary for the performance of the contract between you and us; or
  • to the extent necessary for the establishment, exercise or enforcement of legal claims; or
  • in connection with the use of certain software applications. In this case, an adequate level of protection is ensured through the use of the European Commission's model provisions.

2.4. What rights do you have as a data subject?

You have several rights:

  • You always have a right of access to your personal data. This allows you to check which personal data we process about you.
  • You always have a right to rectification of your personal data. This allows you to correct or complete inaccurate or incomplete personal data that we process about you.
  • You have a right to erasure of your personal data. This allows you to permanently delete personal data that we process about you. We are not always obliged to erase your personal data at your request - this right applies only in the cases and to the extent provided by law.
  • You have the right to restrict the processing of personal data concerning you. This allows you to restrict our use of your personal data without deleting it. We are not always obliged to restrict your personal data at your request - this right applies only in the cases and to the extent provided by law.
  • You have the right to object to the processing of your personal data. This allows you to oppose further processing of your personal data. We are not always obliged to comply with your objection - this right only applies if we process your personal data on the basis of our legitimate interest.
  • You always have the right to withdraw your consent if the processing of your personal data is based on your consent.
  • You always have the right to object to the processing of your personal data for direct marketing purposes.
  • You have the right to data portability. This allows you to easily transfer, copy or forward personal data from one controller to another. This right can only be exercised if our processing is based on your consent or on an agreement with you.

3. Processing operations that may apply to you

We process your personal data for the following purposes and under the following conditions.

3.1. You are a client of Tiberghien Economics

If you are our client or work at/for our client, we process your personal data for the following purposes:

  • Client management (file management, client relationship management, invoicing, etc.) based on the need to perform a contract with you. Without your personal data, we cannot perform the contract;
  • Mandatory notifications based on the need to comply with a legal obligation we have to fulfill (e.g. anti-money laundering and KYC notifications);
  • Direct marketing based on the need to meet our legitimate interest. Our legitimate interest is to better serve you as a customer by keeping you informed of our activities and expertise;
  • Building know-how based on our legitimate interest. Our legitimate interest is to increase our know-how and improve our expertise. Furthermore, this is also in the interest of our clientele to allow us to provide a better service, and in the interest of the general public when we use this know-how to write and publish scientific papers.

We retain your personal data for up to 10 years after the file is closed (and up to 30 years for real estate files), depending on the type of file and the applicable prescription periods. Advice we provide and other documents containing your personal data may be retained longer for the purpose of building know-how. We delete them as soon as they are no longer useful for our services.

If, in the course of handling a file, you entrust us with personal data of persons other than yourself (contact persons, etc.), we will assume that you are lawfully processing these data and that you are lawfully disclosing them to us.

In the course of fulfilling these purposes, we may communicate your personal data to:

  • Tiberghien Belgium, Tiberghien Luxembourg, Tiberghien Economics and the employees, interns, consultants, trainee lawyers and partners of these companies or their affiliates, to the extent necessary to process your file;
  • Subcontractors who process personal data on our behalf (processors);
  • Independent consultants to the extent necessary for the organization of Tiberghien Economics, the processing of a file or the establishment, exercise or support of a legal claim;
  • Judicial, police or administrative authorities when required by law or to the extent necessary for the processing of a file or the establishment, exercise or support of a legal claim;
  • Insurers, when our services are covered by your legal expenses insurance or insurers intervene in a case.

3.2. You are a prospective client of Tiberghien Economics

If you are a prospective client, we process your personal data for the following purposes:

  • Prospect management based on your consent (if you have provided us with your personal data yourself), based on the need to pursue our legitimate interest (if we have obtained your personal data from a third party or from a public source) or based on the need to take pre-contractual measures (if you wish to become a client). Our legitimate interest mentioned above is to identify market opportunities;
  • Direct marketing based on your consent. You can withdraw your consent at any time.

We will retain your contact information for as long as you do not withdraw your consent, or for up to 1 years after our last contact.

In the course of fulfilling these purposes, we may disclose your personal data to:

  • Employees or interns of or in connection with us, to the extent that they need your personal information to perform their tasks;
  • Subcontractors who process personal data on our behalf (processors).

3.3. You are a supplier of Tiberghien Economics

If you provide products or services to us or work at/for a supplier of products and services, we process your personal data for supplier management purposes based on the need to perform a contract with you. Without your personal data, we cannot fulfill the contract.

We retain your personal data until the expiry of the tax and accounting prescription periods (7 years until 2022, 10 years from 2023 onwards).

In the course of fulfilling this purpose, we may disclose your personal data to:

  • Employees or interns of or in connection with us, to the extent that they need your personal information to perform their tasks;
  • Subcontractors who process personal data on our behalf (processors).

3.4. You are a visitor to the offices of Tiberghien Economics

When you visit our offices, we process your personal data for the following purposes:

  • Visitor management based on the need to protect our legitimate interest. Our legitimate interest is to ensure (fire) safety, confidentiality and organization of activities/meetings;
  • Direct marketing based on your consent. You can withdraw your consent at any time.

We retain your personal data for up to 1 year since your last visit.

In the course of fulfilling these purposes, we may disclose your personal data to:

  • Employees or interns of or in connection with us, to the extent that they need your personal information to perform their tasks;
  • The manager of the building in which our offices are located (if applicable);
  • Subcontractors who process personal data on our behalf (processors);
  • Independent consultants to the extent necessary for the organization of Tiberghien Economics, the handling of a case or the establishment, exercise or support of a legal claim;
  • Judicial, police or administrative authorities when required by law or to the extent necessary for the processing of a file or the establishment, exercise or support of a legal claim.

3.5. You are a participant in one of the activities of Tiberghien Economics

If you participate in an activity of Tiberghien Economics (reception, seminar, webinar, etc.), we process your personal data for the following purposes:

  • The organization of the Tiberghien Economics activity based on the fulfillment of the agreement with you, in particular your registration to our activity;
  • Direct marketing based on our legitimate interest. Our legitimate interest is to inform you about other Tiberghien Economics activities and about our expertise in order to better serve you.

We retain your personal data for up to 1 year after you become inactive as a contact.

In the course of fulfilling these purposes, we may disclose your personal data to:

  • Employees or interns of or in connection with us, to the extent that they need your personal information to perform their tasks;
  • Subcontractors who process personal data on our behalf (processors).

3.6. You are a visitor to the Tiberghien Economics website or social media channels

If you visit the Tiberghien Economics website or one of our social media channels, Tiberghien Economics processes your personal data for the following purposes:

  • To respond to your question or request for information, to take pre-contractual measures at your request;
  • For direct marketing, including to inform you about Tiberghien Economics' activities, if you consent;

In the course of fulfilling these purposes, we may disclose your personal data to:

  • Employees, interns, consultants, trainee lawyers and partners of these companies or their affiliates, to the extent necessary to perform their tasks;
  • Subcontractors who process personal data on our behalf (processors);
  • The third parties mentioned in our Cookie Policy.

 

Use of or interaction with social media is subject to the social network's own rules. Tiberghien Economics has no control over this. Please consult the terms of use and privacy policy of the relevant social network to understand how the network handles your personal data.

 3.7. You are an applicant for employment at Tiberghien Economics

If you apply for a job with us or participate in job fairs, we process your personal data as an applicant for:

  • Managing and evaluating your job application in the context of pre-contractual measures;
  • Maintaining a recruitment reserve based on our legitimate interest. Our legitimate interest is to contact you at a later date for a job opportunity if there is no immediate vacancy. If you do not wish to be included in the recruitment reserve, you may object at any time.

We will retain your personal data for up to 2 years after your application (unless you object).

In the course of fulfilling these purposes, we may disclose your personal data to:

  • Employees or interns of or in connection with us, to the extent that they need your personal information to perform their tasks;
  • Subcontractors who process personal data on our behalf (processors).

3.8. In any case:  fraud, abuse and dispute management

In any case, regardless of your relationship with us (i.e. if you are a visitor, a customer, etc.), we may also process your personal data for the following purposes:

  • Detecting, preventing and combating fraud and abuse based on the need to protect our legitimate interest. Our legitimate interest is to reduce fraud and abuse;
  • Managing our own disputes based on the law of 30 July 2018 (art. 10 §1, 1°) and the need to protect our legitimate interest. Our legitimate interest is to protect our rights in the context of disputes.

In this case, we will retain your personal data for up to 20 years, unless the detection, prevention and combating of fraud and abuse or the management of disputes require a longer retention of personal data.

In the course of fulfilling these purposes, we may disclose your personal data to:

  • Tiberghien Belgium, Tiberghien Luxembourg, Tiberghien Economics and the employees, interns, consultants, trainee lawyers and partners of these companies or their affiliates, to the extent necessary for them to perform their tasks;
